Beaucoup (y compris les employeurs) pr\u00e9tendent que l’indemnit\u00e9 de d\u00e9part n’est jamais pay\u00e9e pour un employ\u00e9 qui a d\u00e9missionn\u00e9 et qui n’a pas \u00e9t\u00e9 licenci\u00e9. Habituellement, pour avoir droit \u00e0 une indemnit\u00e9 de licenciement, un employ\u00e9 doit travailler pour le m\u00eame employeur pendant un an et avoir quitt\u00e9 son emploi, non de son plein gr\u00e9. Mais cette affirmation n’est pas tout \u00e0 fait correcte. Dans quels cas une indemnit\u00e9 de d\u00e9part sera-t-elle due \u00e0 un travailleur qui a d\u00e9missionn\u00e9 ?<\/h3>\n

A) quand il est inscrit dans le contrat de l’employ\u00e9<\/p>\n

La raison la plus courante est, bien s\u00fbr, lorsque cela est sp\u00e9cifi\u00e9 dans le contrat de travail de l’employ\u00e9. Si l\u2019employ\u00e9 signe une convention collective ou si un contrat personnel est sign\u00e9 entre l\u2019employ\u00e9 et l\u2019employeur conform\u00e9ment \u00e0 l\u2019article 14 de la loi sur les indemnit\u00e9s de licenciement, c\u2019est-\u00e0-dire que l\u2019employeur a vers\u00e9 l\u2019indemnit\u00e9 de d\u00e9part par avance, il recevra \u00e9galement une indemnit\u00e9 de d\u00e9part s\u2019il quitte volontairement son emploi. Dans ce cas, peu importe combien de temps il a travaill\u00e9 et pour quelle raison il a quitt\u00e9 le lieu de travail. En tout \u00e9tat de cause, il per\u00e7oit une indemnit\u00e9 de licenciement en fonction du temps qu’il a r\u00e9ussi \u00e0 travailler avant son d\u00e9part.<\/p>\n

B) Selon la l\u00e9gislation du travail isra\u00e9lienne, une indemnit\u00e9 de licenciement est due \u00e0 un employ\u00e9 qui a d\u00e9missionn\u00e9 en raison de :<\/p>\n

Il existe en fait un grand nombre de circonstances, conform\u00e9ment au droit du travail isra\u00e9lien, et un employ\u00e9 peut recevoir une indemnit\u00e9 de d\u00e9part partielle ou totale apr\u00e8s sa d\u00e9mission. M\u00eame si son contrat est tout \u00e0 fait normal. La liste est longue et complexe, mais voici certaines des raisons les plus courantes :<\/p>\n

-Atteindre l’\u00e2ge de la retraite.<\/p>\n

-Maladie de l’employ\u00e9 ou d’un membre de la famille \u00e0 traiter.<\/p>\n

-D\u00e9t\u00e9rioration des conditions de travail (si l’employeur a re\u00e7u un avertissement et une possibilit\u00e9 d’am\u00e9lioration)<\/p>\n

-Recrutement dans les forces de s\u00e9curit\u00e9 (Tsahal, Service national)<\/p>\n

-Fermeture du lieu de travail<\/p>\n

-D\u00e9m\u00e9nagement, mais uniquement dans des circonstances particuli\u00e8res (mariage, divorce et plusieurs circonstances prescrites par la loi)<\/p>\n

En r\u00e8gle g\u00e9n\u00e9rale, la l\u00e9gislation isra\u00e9lienne tente de soutenir les travailleurs qui ont \u00e9t\u00e9 forc\u00e9s de quitter leur emploi de leur plein gr\u00e9. Ainsi, les femmes qui vivent dans un foyer pour femmes battues sont consid\u00e9r\u00e9es comme licenci\u00e9es m\u00eame si elles ont quitt\u00e9 le lieu de travail volontairement. M\u00eame un travailleur d\u00e9c\u00e9d\u00e9 est consid\u00e9r\u00e9 comme licenci\u00e9 et sa famille re\u00e7oit le versement de l’indemnit\u00e9 de licenciement.<\/p>\n
